Adult & Child Orders of Protection in Missouri

The appropriate petition depends on who needs protection and the conduct involved. The Missouri Adult Abuse Act governs many adult proceedings involving allegations of abuse, stalking, or sexual assault.

Missouri law generally recognizes two categories:

  • Adult order of protection: This remedy may apply to current or former spouses, family or household members, people who share a child, current or former dating partners, and certain people subjected to stalking or sexual assault.
  • Child order of protection: A parent, guardian, or another legally authorized adult may seek an order on behalf of a child when the statutory requirements are met.

Either category may involve an ex parte order of protection followed by a full hearing. An ex parte order provides temporary relief that a judge may grant before the respondent receives notice or presents a response. Eligibility and filing requirements depend on the facts, so general information can’t replace advice about a specific situation.
