A postnuptial agreement isn’t limited to any one situation. Several common circumstances lead couples to explore this option:

What a Missouri Postnuptial Agreement Can & Cannot Address

A postnuptial agreement can cover a wide range of financial and property matters. Common subjects include the division of marital and separate property, spousal support provisions or waivers, debt allocation, business interests, and inheritance rights. When drafted thoughtfully, these agreements can also serve an estate planning function by specifying what happens to property upon a spouse’s death.

Missouri law sets one clear limit: a postnuptial agreement cannot govern child custody, visitation, or child support. Courts determine those matters based on the best interests of the child at the time of any dissolution proceeding, and no agreement between spouses can override that standard.

Missouri Enforceability Standards for Postnuptial Agreements

For a postnuptial agreement to hold up in a Missouri court, it must be entered into freely, fairly, knowingly, and in good faith, with full disclosure of each spouse’s assets and liabilities. If those requirements are met, the agreement is binding unless a court finds it unconscionable, meaning so one-sided that it creates strongly unequal conditions between the parties.

Missouri hasn’t adopted the Uniform Premarital Agreement Act. Enforceability is governed by Missouri statutes including RSMo 451.220 and applicable case law. Both spouses having independent legal counsel at the time of signing can strengthen an agreement’s enforceability. An agreement that wasn’t signed voluntarily, rested on incomplete financial disclosure, or contains unconscionable terms can be challenged and set aside.

How the Postnuptial Agreement Process Works

The process typically begins with each spouse consulting their own attorney independently. That separation matters: each spouse needs to understand their individual legal rights before any negotiation begins. From there, both parties compile complete financial disclosures covering assets, debts, and income. That disclosure is the foundation of a valid agreement under Missouri law.

Once both parties have a clear picture of the financial landscape, the agreement is drafted in writing, reviewed by both spouses and their respective counsel, and negotiated until both sides agree on every term. Under RSMo 451.220, the final document must be in writing and acknowledged by each party or proved by a subscribing witness. Proper acknowledgment or witnessing can support enforceability if the agreement is ever challenged. If circumstances change later, a postnuptial agreement can be amended or revoked by mutual written consent.

Common Misconceptions About Postnuptial Agreements

One of the most common assumptions is that a postnuptial agreement signals a marriage in trouble. In practice, many couples use them to establish financial clarity within a healthy relationship. Reducing uncertainty around property and debt can ease friction rather than create it.

Postnuptial agreements also aren’t limited to high-net-worth couples. Any married couple with property, debt, a business interest, or children from a prior relationship may have good reason to consider one. Because postnuptial agreements are less broadly known than prenuptial agreements, many couples don’t realize this option exists until they speak with a family law attorney. In some circumstances, a well-drafted postnuptial agreement can also reduce the potential for contentious and costly litigation if the marriage later ends in dissolution.

How Missouri Courts Evaluate Postnuptial Agreement Challenges

A Missouri court may decline to enforce a postnuptial agreement if it finds the agreement wasn’t entered into voluntarily, was based on incomplete or fraudulent asset disclosure, or contains unconscionable terms. Unconscionability under Missouri law means the agreement creates strongly unequal conditions between the parties. The fact that an agreement looks unfavorable in hindsight doesn’t make it unconscionable.

Courts also look at whether both parties had access to independent legal counsel and sufficient time to review the terms before signing. Agreements that shortcut either factor face a higher risk of challenge. Careful drafting that anticipates these standards, including thorough financial disclosure and clearly balanced terms, can strengthen enforceability over time.
