About Child Protection Orders

A child protection order generally prohibits the accused abuser from entering the home where the victim resides or from communicating with the victim. Depending on the case:

  • Some protection orders will outline other prohibited activity.
  • Once filed, the order is issued ex parte – without a hearing.
  • This initial order is temporary, until a hearing can be held.
  • A hearing will be held within 15 days to determine whether the ex parte order will be made into a full order of protection.
  • A full child order of protection may be issued for a time period lasting no more than one year.

If a child custody order is already in place, an order of protection cannot be entered against a parent. To change a custody order, a motion to modify custody or visitation will need to be filed.
